Kanye West is being sued for copyright infringement by German singer Alice Merton, who claims he used her song “Blindside” without permission. Merton stated that West used an unauthorized sample of her song in his track “Gun to My Head.” Now, she is seeking damages and legal action over the alleged violation.

Why was Kanye West sued by Alice Merton?

German singer Alice Merton has sued Kanye West, accusing him of the unauthorized use of her song “Blindside” in his track “Gun to My Head.” The lawsuit was filed on March 25 and states that West incorporated elements of “Blindside” into his track “Gun to My Head” despite being denied clearance. According to the filing, Merton declined West's request to use “Blindside” in February 2024. She cited personal beliefs as the reason, stating that she did not want to be associated with West due to his history of antisemitic and racist remarks. However, West had already previewed “Gun to My Head” at his Vultures album event in December 2023. At the event, fans noticed the alleged use of “Blindside” despite the lack of approval.

The lawsuit further details the backlash Merton faced after refusing clearance. Fans of West allegedly harassed her online and made threats, pressuring her to reconsider. The situation reportedly made Merton feel unsafe about returning to the U.S. for her upcoming tour dates.

In August 2024, BMG, representing Merton, sent West a cease-and-desist letter demanding that he stop using the sample. According to the filing, West never responded. Now, Merton and the other plaintiffs are seeking injunctive relief, damages, and a jury trial to address the alleged copyright violation and its consequences.

Merton, along with her legal representatives, argues that West's actions directly violated copyright laws and disregarded her refusal. As of now, West has not commented on the lawsuit.
